YOU ACKNOWLEDGE THAT KarinTarQwyn.COM SERVICES ARE PROVIDED "AS IS, AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND INCLUDING, WITHOUT LIMITATION, ANY WARRANTY WITH RESPECT TO THE QUALITY, PERFORMANCE OR FUNCTIONALITY OF KarinTarQwyn.COM SERVICES OR WITH RESPECT TO THE QUALITY OR ACCURACY OF ANY INFORMATION OBTAINED FROM OR AVAILABLE THROUGH USE OF KarinTarQwyn.COM SERVICES OR ITS SUPPLIERS THAT KarinTarQwyn.COM SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. KarinTarQwyn.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

IN NO EVENT SHALL KarinTarQwyn.COM BE LIABLE UNDER ANY SECTION OF THESE TERMS AND CONDITIONS OR UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL OR EQUITABLE THEORY FOR ANY INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF USE, LOST PROFITS, LOSS OF DATA OR INFORMATION OF ANY KIND OR LOSS OF BUSINESS GOODWILL OR OPPOR-TUNITY) WHETHER OR NOT KarinTarQwyn.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES. KarinTarQwyn.COM SHALL NOT BE LIABLE FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY AND IN NO EVENT SHALL KarinTarQwyn.COM'S LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100.00). NO ACTION, REGARDLESS OF FORM, ARISING OUT OF THESE TERMS AND CONDITIONS MAY BE BROUGHT BY YOU OR KarinTarQwyn.COM MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION HAS ACCRUED.

Entire Agreement. These Terms and Conditions constitute the sole agreement between KarinTarQwyn.com and You respecting the subject matter hereof and fully supersede any and all other agreements, either oral or in writing. You acknowledge and agree that You have read these Terms and Conditions and understand their terms.

Legal Actions. This Agreement and its validity, construction and performance shall be governed in all respects by the laws of the State of Nebraska. Exclusive jurisdiction and venue for all matters related to this Agreement shall be in the state of Nebraska, and the parties hereby agree and consent to such jurisdiction and venue.

Any claim or controversy that arises out of or relates to this Agreement, or the breach of it, shall be settled by arbitration in accordance with the rules of the American Arbitration Association. Judgement upon the award rendered may be entered in any court with jurisdiction.

Severability. If any provision of these Terms and Conditions is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to affect the original intentions of the parties, and the remainder of these Terms and Conditions shall remain in full force and effect.

No Waiver. Any failure of KarinTarQwyn.com to enforce any provision of these Terms and Conditions shall not constitute a waiver of any rights under such provision or any other provision of these Terms and Conditions.

Jury Trial Waiver. YOU AGREE TO WAIVE ANY RIGHT TO TRIAL BY JURY.
